Please be advised that the Record of Site Condition (RSC) will not be null or void due to the removal of transite pieces from the site. The RSC is submitted to the Ministry of the Environment and Energy when a proponent and the consultant who performed the site remediation work to indicate that the work has been completed in keeping with the "Guideline for Use at Contaminated Sites in Ontario." The Ministry acknowledges the RSC and may also choose at random to audit the the Consultant's reports to ascertain whether the statements provided are reliable and that the Consultant followed the "Guideline for Use at Contaminated Sites in Ontario.

As I stated in my initial response to you, the Ministry's audit of the site has not been completed and the collection and removal of pieces of transite debris from the site does not interfere with the Ministry's audit process.

The management of the site remains with the property owner and those undertaking the work. The audit does not eliminate the need for decision making or the use of professional skills and judgement to ensure that the site is suitable for the intended use.

In regards to the protocol in place for work being conducted at the site, the removal of transite pieces does not violate any part of this Ministry's legislation. Candec Consultants Ltd. informed me that the pieces of transite were bagged and was disposed off at a licenced receiving facility. The Ministry of the Environment and Energy will confirm that the transite was disposed off properly through the manifest or bill of lading. Please be assured that if any part of this Ministry's legislation is contravened the appropriate action will be taken.
