TERMS OF REFERENCE
BACKGROUND
The City of Toronto has received an application for a demolition permit for the building located on the Manson lands ( 5421 Lawrence Ave. E. at Port Union Rd.) in conjunction with a proposed Remedial Action Plan and a decommissioning report for these lands.
The City of Toronto is required to ensure that the applicable requirements of the Ministry of Labour (MOL) and the Ministry of Environment and Energy’s (MOEE) regulations and guidelines respecting asbestos and other contaminants have been satisfied prior to the issuance of the demolition permit at this site. An executed agreement exists between the former City of Scarborough and Manson Insulation Inc. concerning the clean-up of the site and the conditions of the demolition permit issuance.
PURPOSE
The purpose of this project is to retain a consulting engineering firm to undertake a Peer Review of all relevant data prior to the permit issuance and to carry out field monitoring during demolition and site remediation and to provide appropriate reports to the City. Due to the sensitive nature of the project, the City expects a high level of service from the Peer Review consultant.
SCOPE OF WORK
Part 1. Review of Remedial Action Plan
1. Review all relevant reports including ,
(a). Environmental Site Investigation Summary report, dated May.1997 by R.V. Anderson Associates Limited ,
(b). Execution Work Plan for Facilities Dismantling / Demolition and Removal dated April, 1997, by Greenspoon Bros. Brampton ,
(c). Environmental Site Investigation Summary Report, Addendum dated June 1998, by R.V. Anderson Associates Limited
(d). Reports (if any) issued by the MOEE and/or by the MOL
(e). Revisions (if any) to reports (a) to (d) above.
and advise the City on the acceptability of the findings and the recommendations in the reports regarding the Remedial Action Plan for the Demolition of the building and handling and removal of asbestos and all other contaminants from the site,
2. Review all procedures necessary to ensure compliance with applicable environmental and occupational health and safety laws regarding the handling and removal of all contaminants to the satisfaction of the MOEE and/or the MOL,
3. Ensure site assessment meets good engineering practice and is in compliance with the latest MOEE " Guidelines for Use at Contaminated Sites in Ontario , June , 1996" , and report on the above to the City .
4. On behalf of the City, attend a Community Public Meeting with the concerned parties to review the project .
Part 2. Field Review of the Demolition and Remedial Work
1. Review the field inspection and test reports provided by the applicant or his agents and the MOEE and/or the MOL,
2. In coordination with the applicant and other Government agencies, conduct field inspections as necessary to provide general field review of the demolition and remediation work to ensure compliance with applicable environmental and occupational health and safety laws,
3. Report on unusual site conditions and make recommendations concerning any additional testing or remediation to achieve a safe and clean site for future development .
4. Advise the City regarding the level of clean-up achieved based on the MOEE and /or the MOL regulations and guidelines as applicable for the future intended use ,
5. On behalf of the City, attend one or two Community Public Meetings with the concerned parties to review the project.

The following information will be available to the selected consultant on a request basis for use during the project:

f. Agreement dated March 6, 1995 between the City of Scarborough and Manson Insulation Inc.
PROPOSAL SUBMISSION REQUIREMENTS
The submitted proposal must include the following:
a. A methodology of the work that will be done which exhibits the Consultant’s clear understanding of the Scope of Work;
b. Consultant’s experience on projects of a similar nature;
c. A resume for each of the staff that will be assigned to the project and their anticipated responsibilities on the project;
d. A detailed work plan;
e. Estimated total cost (including disbursements) and staff hours broken down as follows:
1. Part 1: Review of Remedial Action Plan
2. Part 2: Field Review of Demolition and Remedial Work
The total estimated fee will be inserted in the Purchase Order, issued to the successful Consultant, as the upset limit. Goods and Services Tax is NOT to be included in the total fee.
f. Hourly rates of the Project Manager and other key personnel (including sub-consultants, if any) that form the total fee for the whole project.
g. A statement of the basis for payment by the City to the Consultant, including the basis of pricing and the timing of payment.
h. A statement that your firm and sub-consultant (if any) have no conflict of interest by undertaking this peer review.

In response to a specific query, Mr. Parikh advised the CCRA on May 3 that the Award Announcement and the Start-up Meeting had not taken place as the Peer Reviewer selection process was not completed.
OTHER CONTRACTUAL MATTERS
1. The successful Consultant must provide the following proof of insurance coverage to the City prior to the issuance of the Purchase Order for this project:
a. Comprehensive General Liability Insurance in the amount of not less than $5,000,000.00 Bodily Injury and Property Damage (Inclusive Limits), per claim;
b. Automobile Insurance in the amount of not less than $1,000,000.00 Bodily Injury and Property Damage (Inclusive Limits), per claim; and
c. Engineering and Architectural Services- Professional Liability - Error Omissions Insurance in the amount of not less than $1,000,000.00 per claim.
Note: Comprehensive General Liability and Automobile Insurance must be submitted on City of Toronto forms (No other forms will be accepted). All associated costs of this provision are to be included in the estimated upset limit price.
2. All proposals submitted to the Corporation of the City of Toronto become the property of the City and as such, are subject to the Municipal Freedom of Information and protection of Privacy Act.
